They would have to have the parent who ( does not sign) declared as unfit. And the burden of proof would fall on the mother and stepfather. This is not easy to obtain as the judge would want proof. Lots of proof!.

If I were the father, tell him to protect his rights , before he leaves the country, by contacting a lawyer. Or if he is already overseas, write to a lawyer , where this might go to court.They can take care of it,until he can get back and protect himself.

This guy needs to talk to his CO, he has more rights while he is overseas than if he were stateside. The child should be getting an allotment, and I cannot imagine a lawyer that would handle it. If they lie on the adoption papers they are both facing criminal charges.

Get an attorney, it looks as if they figure they have rights because the child is not being properly cared for. and the courts may agree with them. Where is the mother, whom where they left with while he left to go overseas, what provisions were made for the care of the child. Where are his parents the biological grandparents in all this. THIS is going to court, he needs some help and fast. What rights does the step parents have over his child. Who are they and where is the mother of the child.
It shouldn't happen since the overseas parent would need to relinquish parental rights. However, if the court thinks he isn't responding to their summons or something like that, they might think he is just ignoring them, and decide to go ahead with the process. He needs to make sure the court knows where he is and he doesn't want the process to go through.

I don't know what he can do overseas, but I do not think the courts would allow this without:





a. his written consent





b. proving he is an unfit/absent parent by choice.





If he is not abusive, a drug addict, or in some other deplorable state I don't think it would be possible
If they know where he is at they have to tell the lawyer this. If he is overseas due to military reasons it will be a lot harder for the stepfather and mother to proceed at this time. If he is just over there then they can go on. Just because the biological father does not consent doesn't mean the child can't be adopted. The stepfather and mother will have to go in front of a judge and explain why they feel the stepfather should become the childs father. It is a little bit of a lengthy process, but it can be done no matter how the father feels.

The biological father can give up his parental rights, which would relinquish him of any responsibility to the child, and/or his rights could be taken away if he was proven to be unfit.


Only then can the child be adopted by the step-parent, because now the father's rights over the child do not exist.





A costly, lengthy court process would be needed if the father absolutely refuses to give up his rights, and the battle is likely not to be vistorious unless the father can be proven to be unfit or gives up under the enormous court cost and stress.

if he is overseas military he needs to contact legal for help to make sure nothing shady happens. if he isn't there they can claim anything. if he pays child support or has been active in the childs life they are gonna have a hard time to make an adoption fly without consent.

I think it would make a difference to me also if my ';original'; parent had passed away or not....i.e. when my dad was alive he was the only one i called dad...now that he's passed on...i called my step-dad dad more often....

It depends on your age and the relationship you have with your birth parents. It also depends on the relationship you have with the step-parent.


My step-children call me by my first name but refer to their mother and I as their parents.

Other than that, as a parent myself, my family usually just asks me what my son needs for christmas or birthdays so they don't get clothes he doesn't need and they know his sizes. WHY I THINK ABORTION IS OKAY:


I think it's the woman's right to choose. It's her body and her life that will be changing.





WHY I THINK IT'S WRONG:


I have seen documentaries on abortion, and I know that when the baby is too old to terminate by a pill, they pull the baby out whilst still alive. Sometimes the only way to retrieve the baby is to pull it by the arm or foot, and since their bodies are so fragile, their limbs are sometimes pulled off (no matter how careful the doctor is). For this reason, I would never have an abortion.





I don't agree in abortion up to 22 weeks. I maintain that if a woman wants an abortion, she should have it as soon as possible. If she has left it so late, she should have the baby and give it up for adoption. You need to remember though, that the only reason babies of 24 weeks can survive, is because healthcare has improved, and these babies are put on months of life support machines. If these machines weren't available, the age of survival for premature babies would be significantly later than 24wks. Therefore the abortion laws in the UK would be more widely accepted.





I also disagree with people that get pregnant and have routine abortions as a consequence of their lifestyle, but this is only a small percentage of cases.





MY CONCLUSION:

It should be a very personal decision. Not everyone who gets pregnant should be a parent. Personally, an unstable or disinterested person should not be charged for having an abortion, but anyone who mistreats a child who is actually here should be charged at the least with child abuse or worse depending on what injustice is done to the child.
i think in my own opinion abortions are fine but not at 22,24 weeks they are fully grown babys at thats stage i could not imagine any doctor aborting a baby at that stage they are most likely do them between 8 and 12 weeks, and even so i dont think that they would leave the baby to die, some babys can survive at 20 weeks

Although I don't morally agree with abortion and would NEVER do it myself, I do have empathy for alot of people and realise that for most women the decision to abort is not an easy one and some people are just not capable of having a child for their own reasons. I agree they should have been more careful but as the child of a love-less, selfish, abusive mother who had me and treated me disgustingly I think that abortion is a better option than this.

No, and it won't happen. The news you read is bunk. Abortions kill the baby while it is still inside of the mother, they do not just pull them out and leave them to die. While I would never want an abortion myself, I am too maternal and would want to keep a baby. Many women make the choice for themselves and should be allowed to continue to do so. Read up on the history of abortion, ever since ancient societies it was a private act, just like sex, and was accepted as normal. This only changed in the US in the late 1800s when men noticed that more of the upper class women were seeking abortions... and of course they couldn't allow that!





Abortion is not a new thing, it has been around for ages... it is only in societies current state of over analizing and reaching into peoples private matters that it has become an issue of this magnitude.





Also *edit* it is not illegal to abort at 22 weeks, it is the second trimester. Look up Roe v. Wade and the precedent that was set. Laws in the US can only govern abortion in the 3rd trimester, and even then there are limits to how much they can be banned.
